OUTDOOR RECREATION, INCLUDING HIKING, INVOLVES INHERENT AND SUBSTANTIAL RISKS OF BODILY INJURY AND DEATH. The Pīpīwai Trail traverses remote terrain within a national park. Hazards include but are not limited to: uneven and slippery trail surfaces, river and stream crossings, flash flooding, falling rocks and debris, dense vegetation, extreme heat and sun exposure, dehydration, wildlife encounters, unstable cliffs and overlooks, rapidly changing weather, limited cell service, limited emergency access, and distance from medical facilities.
By using information on this Site to plan or undertake any outdoor activity, you expressly acknowledge and assume all risks associated with that activity. You represent that you have the knowledge, skills, fitness level, and equipment appropriate to the activity you intend to undertake. Friend of Pipiwai Trail has no ability to assess your individual fitness, experience, or the specific conditions you will encounter on any given day.
Nothing on this Site constitutes a representation that any route, trail, road, or activity is safe, accessible, or appropriate for you or anyone in your group at any given time.

IN ALL CASES, THE TOTAL AGGREGATE LIABILITY OF FRIEND OF PIPIWAI TRAIL TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THIS SITE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ACCESS THIS SITE (WHICH IS ZERO FOR A FREE INFORMATION WEBSITE) OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

We reserve the right to terminate or restrict access to this Site for any user who violates these Terms, at our sole discretion and without notice.
12.No Emergency Services
THIS SITE IS NOT AN EMERGENCY SERVICE AND CANNOT BE USED TO SUMMON RESCUE, MEDICAL, OR LAW ENFORCEMENT ASSISTANCE. If you are in an emergency while hiking, call 911 if cell service is available, activate a personal locator beacon or satellite communicator if you have one, and follow instructions from emergency services personnel. The NPS Haleakalā emergency contact is 808-572-4400.
Do not attempt to contact this Site for emergency assistance. We have no ability to dispatch emergency services or monitor communications in real time.
13.Modifications to Terms
We reserve the right to update or modify these Terms at any time and at our sole discretion. When we make material changes, we will update the date at the top of this page. Your continued use of this Site after any posted modification constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
We may also, at any time and without notice, modify, suspend, or discontinue the Site or any portion of it. We shall not be liable to you or any third party for any modification, suspension, or discontinuance.

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.
These Terms, together with our Privacy Policy and Affiliate Disclosure, constitute the entire agreement between you and Friend of Pipiwai Trail with respect to your use of this Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.
